A Los Angeles County judge has denied Sia’s estranged husband, Dan Bernad, sole custody of their 1-year-old son, Somersault “Summi,” after a tense courtroom battle that has drawn public attention.
The ruling, issued Wednesday, upheld the couple’s existing custody arrangement, with the court saying Bernad did not provide enough evidence to justify an emergency change.
“The court finds that sufficient exigency for the requested emergency relief has not been shown at this time,” the judge wrote in documents obtained by Page Six, noting that the custody terms were already agreed upon in August 2025.
Bernad, a physician, had argued that he was the “only safe and reliable parent,” claiming that Sia, 49, was a “serious and immediate danger” to their child due to alleged substance abuse issues. He also accused the singer of hiding a recent two-week hospital stay in Los Angeles after testing positive for prescription drugs.

Sia strongly rejected the claims, calling them an attempt to “weaponize” her past struggles. The “Chandelier” star has openly spoken about her history with addiction and stated in her court response that she has been sober for six months. She also noted that she has repeatedly agreed to routine drug testing — and alleged that Bernad, not her, failed to comply with previous testing arrangements.
The pop star has maintained primary custody of Summi since she filed for divorce in March after two years of marriage.
In her filing, Sia also referenced a past investigation involving Bernad and alleged illicit material on his computer. The case was ultimately closed without charges, and Bernad has denied any wrongdoing, claiming the situation was fabricated to limit his time with his son.
Bernad had requested full custody along with supervised visitation for Sia and mandatory drug testing, but the court declined to make any changes at this time.

Representatives for both Sia and Bernad have not commented publicly on the ruling.
The custody case remains ongoing.
