Singer Sia and her estranged husband, Dan Bernard, are locked in a tense legal battle over custody of their 1-year-old son, Somersault “Summi,” with both sides making serious accusations.
According to court documents obtained by TMZ, Bernard has requested sole custody, claiming that Sia is a “serious and immediate danger” to their child. Bernard, an oncologist, alleged that the Australian singer is “unfit and unreliable” and struggling with substance abuse. He also asked the court to require Sia to undergo random drug testing and to limit her to supervised visits with Summi.
Sia, 49, has denied the accusations. In her legal response, she said she has been sober for more than six months and argued that Bernard is using her past struggles against her. The Grammy-nominated artist has spoken publicly in the past about overcoming addiction more than a decade ago.

“Dan’s attempt to weaponize my past sobriety journey serves no legitimate purpose and is intended only to distort the facts,” she said in court filings.
Sia also claimed that she has consistently agreed to mutual drug testing, and alleged that Bernard refused the same request.
The singer, who has had primary custody of Summi since filing for divorce in March after two years of marriage, further alleged that Bernard had previously been the subject of an investigation by Los Angeles authorities involving “illicit child pornography” found on a hard drive. Sia said this led her to request restrictions on his visitation at the time. According to her filing, the investigation was later closed without a confirmed result.

Bernard has denied any wrongdoing and claimed Sia “planted evidence” to limit his access to their child.
The court has not ruled on the latest requests, and no criminal charges have been filed in relation to the allegations on either side.
The custody dispute remains ongoing.
